Cool down period & return of goods

Save for certain products that are excluded from this policy, you are entitled to return any purchase concluded on The Chocolate Tree and delivered within South Africa within seven (7) days of the Goods having been delivered to you. In such an event, you will receive a full refund of the purchase price within thirty (30) days of the date of cancelling this agreement. You undertake not to utilise the Goods, your agreement of purchase will be deemed to have been cancelled, and you will be liable in terms of section 44(2) of the Electronic Communications and Transactions Act 25 of 2002 (as amended from time to time) for the direct costs of returning the Goods, such as courier and/or shipping charges. Please note that your right to cancel your order for Goods without penalty set out in this clause, shall not apply where the Goods have been removed from their original packaging or fall into the category of perishable, or where goods are made to your specifications or are clearly personalised.

Please note that in terms of section 20 of the Consumer Protection Act, perishable goods and/or consumables may not be returned.

Please note Eitz Shokolaat will not accept any returns of any products of which the packaging has been removed, opened or tampered with, and products of a personal nature due to hygiene and sanitary considerations.

Delivery

Eitz Shokolaat will deliver the Goods to you as soon as reasonably possible, but no later than thirty days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within seven days of receiving such notification elect whether or not to proceed with your order for the Goods. If you elect not to proceed with your order, we will reimburse you with the purchase price within thirty days of having informed you that we are not able to deliver the Goods during the Delivery Period.

General warranty:

If Within 6 months of delivery of a product, you find that the product is faulty, not commercially acceptable, unsuitable for the purpose generally intended, or not legally or reasonably durable (based on the circumstances and product type) (“defective”);

Please contact the Chocolate Tree on support@thechoctree.com or 0116407641 to notify us thereof. We will request pictures of the defective product and will arrange to collect such product from you so that it can be inspected by our Quality Assurance team.

Exclusions:

Unless defective, the following product types may not under any circumstances be returned to The Chocolate Tree:

Goods which due to their nature are consumable and perishable goods in terms of section 20 of the Consumer Protection Act or where hygiene reasons are applicable;

Products that you or any other person has altered, repaired, incorporated or added to where such alteration, repair, incorporation or addition has not been authorised by The Chocolate Tree.
